Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the website located at www.televiahealth.com (the “Site”) and the telehealth and related services (collectively, the “Services”) offered by Virtual NP Telemedicine Urgent Care LLC, doing business as Televia Health (“Televia Health,” “we,” “us,” or “our”). By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services. 

1. Eligibility 

You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account or use the Services on your own behalf. Services may be used on behalf of a minor only by a parent or legal guardian who accepts these Terms and provides consent to treatment as required by applicable law. You represent that all information you provide is accurate, current, and complete. 

2. Nature of the Services 

Televia Health provides telehealth consultations and related clinical services, including but not limited to urgent care, weight management, hair loss management, medication refills, and follow-up visits, delivered by licensed healthcare providers through audio, video, or secure messaging. Telehealth services are subject to the clinical judgment of the treating provider, who may determine that your condition is not appropriate for telehealth and may refer you to in-person or emergency care. 

Our Services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. 

3. Account Registration and Security 

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. 
  • You agree to notify us promptly of any unauthorized use of your account or any other breach of security. 
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or unsafely. 

4. Patient Responsibilities 

  • Provide accurate, complete, and truthful information about your medical history, symptoms, and current medications. 
  • Use the Services only for lawful purposes and in accordance with your provider’s instructions. 
  • Understand that a telehealth visit does not guarantee a specific diagnosis, prescription, or treatment outcome. 
  • Seek in-person or emergency care when advised to do so by your provider or when your condition warrants it. 

5. Fees, Billing, and Insurance 

Fees for Services, including any applicable co-payments, deductibles, or self-pay rates, will be disclosed to you prior to or at the time of service. Where applicable, we may submit claims to your health insurance on your behalf; however, coverage and reimbursement are determined by your insurance plan, and you remain responsible for any amounts not covered. Payment terms, cancellation, and no-show policies may be described separately at the time of scheduling. 

6. Prescriptions 

Any prescription issued through the Services is at the sole discretion of the treating provider based on clinical evaluation. Not all conditions or medications are appropriate for telehealth prescribing, and controlled substances may be subject to additional legal restrictions, including in-person examination requirements under applicable federal and state law. Televia Health does not guarantee that any specific medication will be prescribed. 

7. Intellectual Property 

All content on the Site, including text, graphics, logos, images, and software, is the property of Televia Health or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except as necessary for your personal, non-commercial use of the Services. 

8. Third-Party Services and Links 

The Site or Services may integrate with or link to third-party platforms, including insurance portals, electronic health record systems, payment processors, and communication tools. We are not responsible for the content, accuracy, or practices of third-party services, and your use of them is subject to their own terms and policies. 

9. Disclaimers 

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TELEVIA HEALTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR CLINICAL OUTCOME WILL RESULT FROM USE OF THE SERVICES. 

10. Limitation of Liability  

TO THE FULLEST EXTENT PERMITTED BY LAW, TELEVIA HEALTH AND ITS OWNERS, PROVIDERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES. NOTHING IN THESE TERMS IS INTENDED TO LIMIT LIABILITY FOR CLAIMS OF PROFESSIONAL NEGLIGENCE OR MEDICAL MALPRACTICE TO THE EXTENT SUCH LIMITATION IS NOT PERMITTED BY APPLICABLE LAW. 

11. Indemnification 

You agree to indemnify and hold harmless Televia Health and its owners, providers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or Services, your violation of these Terms, or your violation of any law or third-party right. 

12. Privacy 

Your use of the Site and Services is also governed by our Privacy Policy and, where applicable, our HIPAA Notice of Privacy Practices, which describe how we collect, use, and protect your personal and health information.  

13. Termination 

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for conduct that violates these Terms, poses a safety risk, or is otherwise harmful to Televia Health, other patients, or third parties. You may stop using the Services at any time by discontinuing access to the Site and closing your account. 

14. Changes to These Terms 

We may update these Terms from time to time to reflect changes in our practices, Services, or applicable law. We will post the revised Terms on this page with an updated effective date. Your continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms. 

15. Governing Law 

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles, unless otherwise required by the law of the state in which you receive care. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ohio, except as otherwise required by applicable law.
